Better AI Pte Ltd (“Better”, “we”, “our”, or “us”) provides software applications, artificial intelligence tools, and related services (collectively, the “Services”) designed to deliver health information. This Privacy Policy (“Policy”) describes how we collect, use, disclose, retain, and safeguard personal information when you access or use our Services.
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to this Privacy Policy in its entirety. If you do not agree, you must not access or use the Services.
This Policy applies globally. Where local laws impose additional requirements, we will comply with those requirements to the extent they are applicable. Nothing in this Policy limits our rights under applicable law or constitutes a waiver of any legal defense or exemption available to us.
1. Nature of Services and Disclaimer
Better provides informational software tools related to health, wellness, nutrition, supplements, biomarkers, and lifestyle optimization. THE SERVICES ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. THEY DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR CLINICAL GUIDANCE AND DO NOT CREATE A PHYSICIAN-PATIENT, CLINICIAN-PATIENT, THERAPIST-CLIENT, OR OTHER PROFESSIONAL OR FIDUCIARY RELATIONSHIP OF ANY KIND.
AI-generated content, insights, scores, recommendations, or outputs produced by the Services are probabilistic, informational, and non-binding. They may be incomplete, incorrect, or inappropriate for your individual circumstances. You are solely and exclusively responsible for evaluating outputs and for consulting qualified, licensed healthcare professionals before making any medical, health, nutritional, pharmaceutical, or lifestyle decisions. Better disclaims all liability arising from your reliance on Service outputs.
2. Information We Collect
2.1 Information You Provide Directly
We collect information you voluntarily provide, including when you: create an account; subscribe to paid features; input data into the platform; connect third-party integrations; respond to surveys or feedback requests; or contact support. This may include your name, email address, contact details, account credentials, billing and payment information, and any content, communications, or records you submit through the Services.
2.2 Health and Wellness Information
If you choose to provide it, we may collect and process health-related and sensitive personal information, including biomarker results, laboratory data, wearable device metrics, nutrition and dietary logs, supplement and medication information, symptoms, health history, body composition data, and personal health goals. Such information may be considered sensitive, special category, or protected data under applicable laws.
You are not required to provide health information to use the Services; however, certain features will not be available without it. By voluntarily inputting sensitive health information, you expressly consent to its collection and processing as described in this Policy.
IMPORTANT: Do not submit information you do not have the right to share, including the health information of third parties without their consent.

4. AI and Automated Processing

AI-generated outputs are probabilistic and informational in nature. They are not guaranteed to be accurate, complete, current, or suitable for any particular purpose or individual circumstance. We make no warranty, express or implied, regarding the reliability or fitness of AI outputs. Users assume full responsibility for evaluating, verifying, and independently assessing all outputs before relying on them in any way.
Where required by applicable law, we will provide you with the ability to request human review of significant automated decisions that materially affect you. Please contact us using the details in Section 18 to make such a request.
We reserve the right to modify, retrain, or discontinue any AI feature at any time without notice.
4A. AI Training and Data Usage
Better may use anonymized, aggregated, or de-identified user interaction data to:
improve and optimize algorithms and AI models
refine and retrain machine learning models
conduct internal research, benchmarking, and analytics
develop new features and product capabilities
Personally identifiable information is processed in accordance with this Privacy Policy and applicable law. We do not use identifiable personal health information to train AI models without your express consent, except where permitted by applicable law on an anonymized or de-identified basis.
Where we seek to use your personal information for AI training purposes beyond what is described in this Policy, we will notify you and obtain any required consent in advance.

We may share aggregated, anonymized, or de-identified information that does not reasonably identify individuals with third parties for any lawful purpose, without restriction.
7. International Data Transfers
Better operates globally and is headquartered in Singapore. Personal information may be transferred to, stored in, and processed in jurisdictions outside your country of residence, including jurisdictions that may have different or less stringent data protection laws than your home jurisdiction.
By using the Services, you acknowledge and consent to the international transfer of your personal information. We implement commercially reasonable safeguards for such transfers, which may include contractual protections (such as standard contractual clauses where applicable), technical security measures, and vendor due diligence.

In the event of a security incident that requires notification under applicable law, we will notify you as required by law. We are not liable for any unauthorized access to your information that results from circumstances beyond our reasonable control, including your own failure to secure your account credentials.
10. Your Rights, Choices, and International Privacy Compliance
10.1 General Rights
Depending on your jurisdiction and applicable law, you may have certain rights with respect to your personal information. We recognize that health and biomarker data is sensitive. We take additional precautions for such data, including limiting access on a need-to-know basis, applying encryption both in transit and at rest, and conducting periodic review of data access logs.
Notwithstanding these precautions, you acknowledge and agree that: (a) providing sensitive health data to any online service involves inherent risks; (b) Better is not a covered entity or business associate under HIPAA and does not represent that the Services are HIPAA-compliant, unless expressly agreed in a separate written Business Associate Agreement; (c) Better does not represent that the Services are compliant with any specific clinical data regulation unless expressly stated in writing; and (d) you use the Services at your own risk and Better is not responsible for any harm arising from your provision of sensitive information to the Services.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BETTER DISCLAIMS ALL LIABILITY FOR: (A) ANY LOSS, DAMAGE, OR HARM ARISING FROM YOUR USE OF OR RELIANCE ON AI-GENERATED OUTPUTS OR SERVICE CONTENT; (B) UNAUTHORIZED ACCESS TO OR DISCLOSURE OF YOUR PERSONAL INFORMATION RESULTING FROM CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL; (C) YOUR FAILURE TO IMPLEMENT ADEQUATE ACCOUNT SECURITY; OR (D) ANY ACTS OR OMISSIONS OF THIRD PARTIES.
Nothing in this Policy limits liability that cannot be excluded under applicable law. In jurisdictions where limitations of liability in privacy policies are restricted, this section shall apply only to the extent permitted.
16. Changes to This Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. Where changes are material, we will notify you through the Services or by email prior to the changes taking effect. Changes become effective on the date specified in the updated Policy. Your continued use of the Services after the effective date constitutes your acceptance of the revised Policy.
We encourage you to review this Policy periodically. If you disagree with any changes, you must stop using the Services and may request deletion of your account.
17. Governing Law and Jurisdiction
This Policy is governed by and construed in accordance with the laws of the Republic of Singapore, without regard to conflict of law principles. Any disputes relating to this Policy shall be subject to the exclusive jurisdiction of the courts of Singapore, except where mandatory local consumer protection laws require otherwise.
Nothing in this section prevents us from seeking emergency or interim relief in any jurisdiction where necessary to protect our rights or the rights of our users.
